Aggrieved by the action of the 1st respondent in not passing orders on the petitioner's appeal No.TW.CV.2/2018, which was filed against order in Rc.No.1906/2002 C1, dated 03.01.2018 passed by the 2nd respondent, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents 1 to 4.
The grievance of the petitioner is that petitioner's Caste Certificate was cancelled vide proceedings in Rc.No.1906/2002 C1, dated 03.01.2018 by the 2nd respondent and consequently Gazette Notification No.4, dated 03.01.2018 was issued. Aggrieved by the order passed by the 2nd respondent in Rc.No.1906/2002 C1, dated 03.01.2018, he filed appeal along with stay petition before the 1st respondent on 25.01.2018 and same is numbered as TW.CV.2/2018.
In view of above facts and circumstances, without expressing any opinion on the merits of the case, since the appeal and stay petition filed by the petitioner is stated to be pending before the 1st respondent, the 1st respondent is directed to dispose of the appeal stay petition pending before him, in accordance with law. Till disposal of the same, there shall be interim stay of the operation of the orders passed by the 2nd respondent vide Rc.No.1906/2002 C1, dated 03.01.2018.
With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
