THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38659 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 and 3 in not registering the crime against the respondents 4 and 5 as illegal and arbitrary, and consequently, to direct the respondents 2 and 3 to register the crime against the respondents 4 and 5 and investigate into the complaint dated 20.07.2016 lodged by the petitioner. Heard and perused the material.

Learned counsel for the petitioner submits that though the petitioner lodged complaint, dated 20.07.2016, the respondents 2 and 3 are not registering the complaint and as such, he prays this Court to direct the respondents 2 and 3 to register the case against the respondents 4 and 5 and take action against them. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the respondents 2 and 3 to register the complaint of the petitioner against the respondents 4 and 5, if it discloses any cognizable offence, and conduct effective investigation and file final report, if any, in accordance with law.
