THE HON'BLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11045 OF 2025 ORDER:

This criminal petition is filed by the petitioner-accused seeking regular bail in connection with Cr.No.211 of 2025 of Narayanaguda Police Station, Hyderabad. The offences alleged against the petitioner are under Sections 109(1) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

The case of the prosecution is that the de-facto complainant lodged a report before the police on 06.08.2025 stating that 15 days back, during Bonalu festival, he sold thotela worth Rs.5,000/- to John Alexander (Bablu), for which payment was not done by Bablu, and he was going on postponing the payment.

On 05.08.2025, the de-facto complainant was at Datha Nagar area; Bablu made a phone call to him for some work, so the de-facto complainant asked Bablu to make the payment of thotela. After some time, Bablu came to Datha Nagar along with his friend viz., Syed Ayan on his two-wheeler and took a knife from his jacket and attacked the de-facto complainant. When he tried to stop him, he got hurt over his head by receiving a blood injury over his head and

left-hand finger. Later, Bablu gave the knife to Syed Ayan and ran from that place. As such, he requested the police to take necessary action against the accused. Basing on the said complaint, the police registered the case against the accused for the above offence.

Heard Sri Pothamshetti Manoj Kumar, learned counsel for the petitioner and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner contended that the petitioner is in jail since 07.08.2025 and he is innocent of the said alleged offence. Moreover, it is a counter case. The de-facto complainant beat the accused with a bamboo stick, and then the petitioner went to the hospital. In the meanwhile, the complainant went to the Police Station to file the complaint against the petitioner, and at the same time, the petitioner's wife also filed the complaint against the de-facto complainant. Due to his political influence, the de-facto complainant was not remanded to judicial custody. There are no specific allegations against the accused, as such, requested the Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposing the same and contended that the allegation against the petitioner is severe in nature, as he has attempted to commit murder, and a knife was recovered from the scene of offence, as such, he is not entitled to bail. He also contended that no other case is pending against the petitioner, and the de-facto complainant sustained grievous injuries. Hence, prays the Court to dismiss the Criminal Petition.

Considering the submissions made by both the counsel and the material placed on record, it shows that both the parties filed cases against each other as there was quarrel between the parties.

Whereas, this petitioner attacked the de-facto complainant's wife with a knife, and as seen from the record, the petitioner is in jail since 07.08.2025 and the material part of the investigation is completed by the investigating agency. As on today, 15 witnesses are examined.

Considering the gravity of the allegations against the petitioner, this Court deems it appropriate to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), each with two sureties for a like sum each to the satisfaction of the learned IX Additional Chief Judicial Magistrate at Nampally.

ii.

The petitioner shall appear before the SHO concerned at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, pending, if any, shall stand closed.
