THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.40578 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 2nd respondent in not registering the sale transactions of the petitioners over their plot on the basis of a letter dated 12.4.2012 issued by the 3rd respondent is illegal, arbitrary, contrary to the provisions of Registration Act and one without jurisdiction and to consequently direct the 2nd respondent to register the sale transactions in Plot No. 87 in Sy.No.371/1P of Madhurawada Village, Visakhapatnam Rural Mandal, Visakhapatnam District and to pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
2. It is reported by the learned counsel for petitioner that the issue in the present writ petition is squarely covered by the orders of this Court in W.P.No.23217 of 2012, dated 12.12.2015 and the copy of the same is placed on record along with the writ petition as material paper.
3. Following the said judgment and for the reasons recorded therein, this Writ Petition is also disposed of, directing the 2nd respondent to receive the document that may be presented by the petitioner in respect of the above mentioned property and register the same subject to the petitioner complying with the provisions of the Act and the Indian Stamp Act, 1899. It is made clear that mere registration of the documents would not absolve the liability of the petitioner and his successors-in-interest of legal action arising out of the enquiry that is stated to be pending with respondent no.3.
4. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
