HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 6021 OF 2017 ORDER:
This Writ Petition was filed challenging the action of respondents 3 & 4 in calling the petitioners to the police station for illegal settlement without committing any offence.
A counter affidavit is filed on behalf of respondents 1 to 3, stating that one K.V.R.Krishna Reddy, filed a private complaint, and the same was referred to the third respondent for investigation. The said complaint was registered as Crime No. 18/2017 on 10.1.2017, against the husband of the 1st petitioner and investigation was taken up. During the course of investigation, the husband of the first petitioner was arrested on 27.1.2017, and was remanded to judicial custody. During the police custody, the accused confessed the involvement of the petitioners in the above offence along with him. In view of the confession, the Investigating Officer has to examine the petitioners to find out their involvement in the offence.
In view of the said facts, the other allegations made in the affidavit filed in support of the Writ Petition were denied.
Since the petitioners were involved in the offence, as per the confessional statement made by the husband of the first petitioner, no relief, as sought, can be granted in the present Writ Petition, and accordingly, the Writ Petition is dismissed.
