THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.17535 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.62 of Gannavaram Village, Macherla Mandal, Guntur District. The authorization of the petitioner is valid upto 13.03.2016. In respect of the allegations and irregularities committed by the petitioner, a criminal case was booked and when the stock was not supplied, the petitioner filed W.P.No.24916 of 2014 and the same was disposed of on 27.08.2014 directing the respondents to supply the stocks to the petitioner so long as his authorization is valid and subsisting. After disposal of the Writ Petition, the supplies were restored by the authorities. The shop of the petitioner was again inspected on 11.05.2015 when the petitioner was not in the shop and a panchanama was conducted on the same day. Challenging the conduct of panchanama, the present Writ Petition is filed. 3.

The learned Government Pleader, on the basis of written instructions, submitted that a case under Section 6-A of the Essential Commodities was booked against the petitioner and the same is pending consideration before the second respondent.

4. In view of the pendency of the 6-A proceedings before the second respondent, the second respondent is directed to conduct an enquiry and complete the same, after giving due opportunity to the petitioner, within a period of three months from the date of receipt of a copy of this order. 5.

The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
