THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 46 of 2015 JUDGMENT: (Per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, namely, the appellant-writ petitioner and the temple authorities, we dispose of the appeal without basically interfering with the judgment and order of the learned Single Judge, whereby His Lordship was pleased to dismiss the writ petition allowing the petitioner to make a representation for continuous possession of the subject property to the temple authorities. However, we modify the said order slightly as follows.
If the writ petitioner-appellant makes a representation within seven days from date, the temple authorities shall consider the same in terms of the order of the learned Single Judge within a period of two weeks from the date of receipt of such representation, and in the event, the representation is rejected, reasons must be given. After disposal of the representation both the parties shall be free to take action in accordance with law, as may be advised. If no representation is made within the time stipulated above, this order will stand recalled and automatically the appeal stands dismissed.
Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
