HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.27285 OF 2019 ORDER:
The present Writ Petition is filed to declare the inaction of the respondents in registering the FIR in spite of receipt of complaints dated 18.11.2019 and 25.11.2019, as being illegal, arbitrary and violative of principle of natural justice. Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Home.
Learned Assistant Government Pleader for Home, based on written instructions dated 12.12.2019, submits that on receipt of complaint from the petitioner, a G.D. entry was made and enquiry was done and on enquiry, it revealed that the matter is purely civil in nature, as such a notice dated 20.11.2017 was sent to the petitioner through registered post on 11.12.2019 vide RN148739297IN. Since a notice has already been issued by the 3rd respondent with regard to the enquiry done based on the complaint of the petitioner, it is open for the petitioner to approach the appropriate forum to avail remedies in accordance with law, if aggrieved by the same.
Subject to the above observation, no further orders need be passed in this Writ Petition. Accordingly, the Writ Petition is closed. No orders as to costs.
As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
