THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26340 of 2017 ORDER:

This Writ Petition is filed challenging the action of respondent Nos.1 to 3 in insisting the petitioner to get the occupancy certificate from the fourth respondent for the purpose of releasing power supply to her premises. Heard the learned Counsel for the petitioner and the learned Standing Counsel for the respondents and perused the material on record and also the orders passed in similar matters by this Court.

It is brought to the notice of this Court that this Court by order dated 13.02.2017 in W.P.M.P.No.3057 of 2017 in W.P.No.2608 of 2017 directed the respondents therein to release the power supply to the building of the petitioner therein subject to the compliance of the terms and conditions of supply of the respondents and the same can be withdrawn if an occupancy certificate was not obtained later from the municipal authorities.

In view of the above, this Writ Petition is also disposed of with a direction to the respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation within the prescribed

period, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
