HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.6065 OF 2016 ORDER:

The petitioner, who is A.1 in Crime No.28 of 2015 of S.H.O., Chaderghat Police Station, Hyderabad, filed this criminal petition under Sections 437 and 439 of Cr.P.C., seeking release in the above crime registered for the offences punishable under Section 302 IPC r/w. 34 of IPC and Section 27 of arms Act.

The petitioner/A.1 and the deceased are neighbours. There were some disputes between their families. It is alleged that the petitioner/A.1 with the help of his mother, who is A.2, used to regularly quarrel with their family members. The deceased being a neighbour used to interfere in the disputes between the accused family. On the date of incident, when the victim was returning from evening prayer, the petitioner/A.1 intercepted him and brutally hacked him with a knife and killed him on the spot, while A.2 instigated the petitioner/A.1 to kill the deceased. Basing on these allegations the above crime came to be registered.

It is to be noticed that earlier this Court vide order dated 09.07.2015 passed in Crl.P.No.6234 of 2015 rejected the bail application of the petitioner after filing of charge sheet. It is now represented by the learned Public Prosecutor that the trial has already commenced and it is

going to be completed shortly.

Having regard to the fact that this Court earlier rejected the bail application of the petitioner/A.1; taking into consideration the gravity of the allegations and as all the inmates of the house are eye witness to the incident, I see no reason to grant bail to the petitioner/A.1, at this stage.

Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
