THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9809 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime.No.549 of 2023 on the file of Mancherial Town Police Station, Ramagundam, registered for the offences under Sections 143, 145 and 307 r/w. 149 IPC. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant lodged a complaint on 29.09.2023 alleging that he was attacked by 9 persons and the names of all 9 persons is mentioned in the complaint. The said 9 persons allegedly attacked with sticks and iron rods resulting in injuries to him and his friend.

Learned counsel appearing for the petitioner would submit that this petitioner has been falsely implicated on the alleged confession made by other accused. The 1st remand report does not mention the name of this petitioner and the 2nd

remand report dated 06.10.2023 reflects the name of this petitioner as A-14.

The complaint itself does not reflect the name of this petitioner and also it is not stated in the complaint that there were any other persons apart from 9 persons in the complaint. However, the basis of implication of this petitioner is confession, for which reason, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner subject to following conditions:-

1) The petitioner/Accused is directed to be released on bail in the event of his arrest by the Station House Officer in Crime No.549 of 2023 on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused shall appear before the concerned Station House Officer, for the purpose of investigation, as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
