HONOURABLE SRI J USTICE N. BALAYOGI CIVIL MISCELLANEOUS APPEAL No. 300 OF 2007 ORDER:

When the matter was listed for hearing on 03.04.2018 and 09.04.2018, learned Counsel for the appellant sought time. Even on 14.4.2018, the learned Counsel for the appellant sought time despite knowing very well that the appeal is of the year 2007. In view of the same, the matter was directed to be listed under the caption 'for dismissal' for today. Even today also, though the matter is listed under the caption 'for dismissal', none appeared for the appellant or made representation on his behalf. The said attitude of the appellant show that he is not interested to prosecute the matter. In the circumstances, this Court has no option except to dismiss the appeal for non prosecution. The Civil Miscellaneous Appeal is therefore dismissed for non-prosecution.
