Seeking the Court to enlarge the petitioner who is arrayed as accused in Crime No.295 of 202 of Ameenpur Police Station, Sangareddy District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 05.06.2025 at 22:00 hours, the complainant came to the Police Station and lodged complaint stating that on 03.06.2025 at about 5:00 PM, while her daughter was returning home from tuition and reached near Road No.19, Narayana Medical Store, an unknown person approached her, asked her name, and then told her to come with him. As she was scared, she ran back home. Again, on 05.06.2025 at about 16:00 hours, while her daughter was going to tuition and was near the same place, the same person approached her, offered to buy her chocolates, caught hold of her hand, and demanded that she fulfill his sexual desire. The girl managed to escape and ran home to inform her mother. When the complainant went to
the spot, the accused fled. Upon enquiry, they came to know his identity as Jayaprakash Pal, son of Balaram, aged 34 years, working as a private employee at Amazon, residing at Flat No.102, Road No.19, Sri Sai Residency, HMT Swarnapuri Colony, native of Allipur, Dhour Junction, Jaipalguri District, West Bengal.

Heard Sri Abhilash Sontake, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offence, that no such incident took place, and that he has been falsely implicated in this case. He further submitted that the petitioner has been in jail since 22.07.2025 and that the material part of the investigation, including proceedings under Section 183 of the BNSS, has been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the allegation against the petitioner is heinous in nature, if he released on bail, he will threaten the victim and his parents. He further submitted that the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.
In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it appears that the petitioner has been in jail since 22.07.2025. As seen from the record, the material part of the investigation has been completed and the statement of the victim has also been recorded. Considering the facts and circumstances of the case, as well as the period of incarceration of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I
Additional District and Sessions Judge, Sangareddy.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
