ORDER

This writ petition under Article 226 of Constitution of India is filed by petitioner seeking to declare the action of 3rd respondent in not taking steps to register a case filed by her by investigating the matter under the superintendence of 2nd respondent, as illegal and arbitrary.

It is stated in the affidavit that the petitioner is the absolute owner of property to an extent of 338 sq. yards in Sy.No.328/2 Old Door Nos.7-61, 62, 63, New Nos.5-305 and that due to threat from the hands of unsocial elements with regard to ownership, she lodged a complaint before the Superintendent of Police on 01.06.2016 and also to the Deputy General of Police, but the same was not registered by the police till today. Hence, she filed the present writ petition.

Learned Assistant Government Pleader informed this Court stating that no complaint as alleged by petitioner is pending with the 3rd respondent.

In view of the submission of learned Assistant Government Pleader, I deem it appropriate to direct the petitioner to file a complaint afresh before the 3rd respondent, and on filing such complaint, the 3rd respondent is directed to register the same, if it discloses any cognizable offence and investigate into the same and file a final report, if any, in accordance with law.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
