THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.23989 of 2018 ORDER:

When the matter is taken up, it is submitted by learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the order, dated 04.07.2018, in W.P.No.19131 of 2018 of this Court. A copy of the same is filed along with the Writ Petition as material papers. The same is not disputed by the learned Government Pleader.

Following the above said order and for the reasons stated therein, this writ petition is also allowed in terms thereof, by setting aside the Order of suspension of licence of the petitioner herein passed by the 4th respondent vide proceedings Rc.No.366/2017/A6, dated 08.052018, as confirmed by the Deputy Commissioner/R.3 vide proceedings Rc.No.110/2016/A2, dated 01.06.2018, and the matter is remitted to the 4th respondent-Excise Superintendent for fresh consideration of the issue and for passing orders afresh, after giving reasonable opportunity to the petitioner herein and after serving a copy of the report of the Excise Inspector. It is also made clear that the it is open for the petitioner herein to submit additional explanation, if any, after furnishing of the said report by the respondents. Office to enclose a copy of the order, dated 04.07.2018, in W.P.No.19131 of 2018 to this order.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
