THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37630 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking a direction to quash the proceedings in FIR No.273 of 2016. The case of the petitioner is that the petitioner is the director of Kalaniketan Textiles and Jewels Private Limited and that the 4th respondent filed a private complaint against the petitioner and others for the offences punishable under Sections 409 & 420 IPC and the same was referred to the 3rd respondent under Section 156(3) Cr.P.C. and thereafter, the 3rd respondent registered the same as Crime No.273 of 2016, alleging that the petitioner induced the 4th respondent to deliver huge quantity of silk sarees and the petitioner made huge profit and dishonestly and fraudulent evaded to pay amount to the 4th respondent.
After arguing for some time, when this Court expressed its opinion that this Court is not inclined to interfere with the investigation in view of the fact that number of cases are pending against the petitioner, but at the same time, considering the fact that the petitioner is already arrested in some cases and released on bail and that the petitioner is a lady and most of the allegations are against the husband of the petitioner, who is the Managing Director of the said company, the 3rd respondent is directed to complete the investigation in FIR No.273 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
