THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.25526 of 2014 ORDER:

This writ petition, filed under Article 226 of Constitution of India, challenges the in-action on the part of the respondents 2 and 3 in investigating the crime in F.I.R.No.105 of 2014 on the file of the Station House Officer, Rajendranagar Police Station, Cyberabad and failure to file final report before the competent Court.

This Court, on 02-09-2014, passed an order in the writ petition, asking the Registrar (Judicial) to ascertain from the VIII Metropolitan Magistrate, Cyberabad at Rajendranagar as to why an adverse remark shall not be ordered to be recorded in his confidential file.

From the note placed on record by the Registry, in obedience to the above said order passed, the then Registrar (Judicial) called for explanation of the VIII Metropolitan Magistrate, Cyberabad vide letter, dated 03-09-2014 and the VIII Metropolitan Magistrate, Cyberabad submitted an explanation on 06-09-2014, stating that he has taken charge of VIII Metropolitan Magistrate, Cyberabad on 10-04-2014 and his predecessor has referred the complaint to Police Station Rajendranagar. It is further stated in the said note that pursuant to the directions of this Court on 04-012016, the Registrar (Judicial) called for information from the VIII Metropolitan Magistrate, Cyberabad, Rajendranagar as to the name of the officer who worked as VIII Metropolitan Magistrate, Cyberabad at Rajendranagar during relevant period and VIII

Metropolitan Magistrate, Cyberabad informed by letter, dated 0501-2016 that it is Sri Ch. Venkateshwara Rao, who forwarded the private complaint vide S.R.No.8627 of 2013, dated 26-09-2013 to the Station House Officer, Rajendranagar, he was transferred from the said Court on 04-04-2014 forenoon. It is further stated in the note that when the Registry enquired with B.Special Section as to the present posting of the said Officer, it is informed that the said officer retired from service on 31-07-2014.

In view of the above reasons, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents-police to complete investigation and to file a final report, in accordance with law, by fixing some time frame. This Court also directed the police not to take further action pursuant to the complaint.

For the aforesaid reasons, the writ petition is disposed of, directing the respondent-police authorities to finalize the investigation and to file a final report in the concerned Court, in accordance with law, as expeditiously as possible preferably within a period of one month from the date of receipt of a copy of this order.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
