HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 8671 of 2016 Order:

This Writ Petition was filed challenging the action of the third respondent in interfering with the civil matters at the behest of the respondents 4 to 6 pertaining to the property bearing Municipal Ward No.23, Door Nos.875, 876 in Survey No.469/2, 1459-1, 1459-2, 473, 474/2, 473/3 and 475 including the playground situated in Nellore Municipal Corporation, SPSR Nellore District. The third respondent is the Station House Officer, IV Town Police Station, Nellore, SPSR Nellore district.

Learned Government Pleader for Home obtained written instructions from the third respondent, who stated that the petitioner earlier filed W.P.No.6985 of 2016 and sought for a direction to register his complaint dated 25.02.2016 sent by registered post. The said Writ Petition was disposed of on 03.03.2016. Pursuant to the said order, a preliminary enquiry was conducted in respect of the complaint and Crime No.85 of 2016 was registered on 03.04.2016 against the respondents 4 to

6. The fourth respondent also lodged a complaint on 25.02.2016 against the petitioner. In respect of the said complaint, Crime No.44 of 2016 was registered on 25.02.2016 against one Shoukath Ali and others. So far as the allegation in respect of the interference in the civil dispute at the instance of respondents 4 to 6 is concerned, the same was denied. The police visited the scene of offence in discharge of their legitimate duties only and not to interfere in the civil disputes.

In view of the said statement, the police are directed to investigate the crimes registered in the Police Station, but they shall not interfere in the civil disputes.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
