HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25643 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the fourth respondent in assessing the petitioner's property as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development, the learned Government Pleader for Revenue for the State of Telangana and the learned standing counsel appearing for the fourth respondent.

3. A perusal of the record reveals that the petitioner purchased an extent of 1435.7 sq.yards of site along with sheds, in Survey No.309 Part, Nizampet Village, Qutbullapur Mandal, Ranga Reddy District under a registered sale deed bearing document No.2451 of 2016, in order to start a small scale industry. The petitioner submitted a representation on 06.07.2016 to the fourth respondentGram Panchayat requesting it to assess the property and allot the number to it.

4. The learned standing counsel submitted that there is no material on record to prove that the petitioner has constructed the sheds after obtaining necessary permission from the concerned authorities.

5. The only relief sought by the petitioner is to direct the fourth respondent to dispose of his representation dated 06.07.2016.

6. In view of the submissions made by both counsel, this

Court is not inclined to go into the merits of the main case.

7. Having regard to the facts and circumstances of the case, the fourth respondent is hereby directed to dispose of the representation of the petitioner dated 06.07.2016 in the light of the provisions of the Andhra Pradesh Panchayat Raj Act, 1994, as expeditiously as possible, preferably, within a period of one month from the date of receipt of copy of this order.

8. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
