THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17126 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Transport (AP). With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in not considering the explanation submitted by the petitioner on 13.04.2016 to the show cause notice dated 30.03.2016 and in not releasing the motor cab bearing No.AP 16 TV 7361 as interim measure in spite of the application submitted by the petitioner under Rule 448-B of the Andhra Pradesh Motor Vehicle Rules 1989, as illegal and arbitrary and consequently, to direct the 3rd respondent to release the aforesaid motor cab.

3. Learned counsel for the petitioner took me through the explanation dated 13.04.2016 to the show cause notice dated 30.03.2016 issued by the 3rd respondent stating that the allegations made are all false and there is no variation in the Chassis number as alleged by the 3rd respondent.

4. As the explanation submitted before the 3rd respondent on 13.04.2016 is still pending consideration, the 3rd respondent is directed to dispose of the same, in accordance with law, as expeditiously as possible, preferably within a period of three (03)

weeks from the date of receipt of a copy of this order.

5. It is needless to mention that the 3rd respondent shall also pass appropriate orders on the interim application made by the petitioner for release of the Motor Cab bearing No.AP 16 TV 7361 at the earliest, in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
