THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9830 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 and 3 in Crime.No.60 of 2023 on the file of Adavidevulapally Police Station, Nalgonda District, registered for the offence under Section 302 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Police registered the case against A-1 to A-3 for committing murder of the deceased who is relative of A-1. According to the remand report, these petitioners were supporting A-1 in family disputes. However, in the remand report, it is alleged that it was A-1 who has killed the deceased with an Axe. It is not mentioned that these petitioners were present when the incident had taken
place. Only on the instigation of these petitioners and family disputes according to the remand report, murder was committed by A-1.

The petitioners are in jail since 11.08.2023. Since , they were not present at the time of incident, however, implication is on the basis of confession of A-1, they can be granted regular bail subject to following conditions: i) The petitioners/Accused Nos.2 and 3 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties, for a like sum each to the satisfaction of I Additional Judicial First Class Magistrate at Miryalaguda.
ii) The petitioners/Accused Nos.2 and 3 after release shall appear before the concerned Station House Officer on every Monday, Wednesday and Saturday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.
iii) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
