THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.27463 OF 2019 ORDER:

The present Writ Petition is filed to declare the action of 4th respondent in not mutating name of the petitioner in Gram Panchayat records for a part of H. No.7-8 situated in Nachupally village, Kodimial Mandal, Jagital District, as per registered will deed document No.63 of 2001 dated 11.04.2001, as being illegal, arbitrary and unreasonable and contrary to law with a consequential direction to the 4th respondent to mutate the petitioner's name in Gram Panchayat records by considering the petitioner's application dated 13.04.2017 and 14.11.2019 in respect of the above said house.

Heard Sri P. Lakshma Reddy, learned Counsel for the petitioner and learned Assistant Government Pleader for Panchayat Raj and learned Standing Counsel for Gram Panchayat for 4th respondent.

Admittedly, the petitioner has made representations to the 4th respondent by his application dated 13.04.2017 and 14.11.2019 seeking mutation of his name in respect of part of house bearing H. No.7-8 situated at Nachupally village, Kodimial Mandal, Jagital District, which the petitioner claims to have possessed under a registered will deed vide document No.63 of 2001 dated 11.04.2001. It is also not in dispute that the said applications are pending consideration by the 4th respondent.

Having regard to the fact that the said applications filed by the petitioner are pending consideration by the 4th respondent and further, when such a representation is made, it is not open for the petitioner to remain silent on such representations without taking a decision in one way or the other, the 4th respondent is hereby directed to consider and dispose of the said representations made by the petitioner in accordance with law within a period of four weeks from the date of receipt of a copy of the order. Subject to the above direction, the Writ Petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
