HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No. 2833 of 2015 DATE: 11.02.2015 Between:

T. Sanjeeva .. Petitioner And State of Telangana and four others .. Respondents

O R D E R:- The case of the petitioner is that the land in an extent of Ac.1.18 guntas in Sy.No.158 situated in Jadcherla village and Mandal, Mahabubnagar District belongs to his grandfather late T.Angadaiah who was in possession and enjoyment of the same till his death on 02.12.2009. After his demise, the petitioner submitted an application to the 4th respondent requesting him to issue pattadar passbook and title deed in his favour but his application was not considered, as such, the petitioner filed W.P.No. 19538 of 2013, and this Court, while disposing of the writ petition directed the respondents to consider the application and pass appropriate orders thereon in accordance with law. In pursuance of the direction given by this Court, the 4th respondent made an endorsement vide Rc.No.ROR/2526/2013, dated 23.08.

2013 directing the petitioner to approach civil Court on the ground that there is a dispute between the petitioner and the 5th respondent with respect to title over the property in question. While so, it is stated that the 4th respondent allotted the land to the 5th respondent, who in turn, sold it to third parties. Now, the petitioner's grievance is that the 4th respondent is allowing the third parties to lay out plots in the land and develop them into house-sites by creating third party interest. Hence, the present writ petition is filed seeking appropriate directions.

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondent Nos.1 to 4 and perused the material placed on record.

Even though it is submitted by the learned counsel for the petitioner that third parties are developing the land into housesites, there is no whisper about the manner of right or interest of the third parties over the land and they are not made party respondents to the writ petition and also there is no material before this Court to the effect that the 4th respondent involved in the development of the land in Sy.No.158 in any manner. There is no co-relation between the photographs which are placed on record and the relief sought for by the petitioner. For want of better material on record, this Court does not consider it desirable to admit the writ petition. Accordingly, the writ petition is dismissed at the admission stage as misconceived. No order as to costs. As a sequel to the dismissal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
