Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as fair price shop dealer of Krishnarayudupeta village, Vepada Mandal, Vizianagaram District. On the basis of a complaint and as per the directions of the 4th respondent, the Deputy Tahasildar, Vepada village and Revenue Officer of Krishnarayudupeta inspected the shop of the petitioner and submitted a report. On receipt of the report, the 4th respondent sent a report to the 3rd respondent. Based on which, the 3rd respondent suspended the authorization of the petitioner's fair shop dealership by order dated 25.10.2014.
Challenging the same, the petitioner preferred an appeal before the 2nd respondent, who confirmed the order of suspension of authorization by order dated 30.03.2015. Questioning the said order, the present writ petition is filed. A perusal of the order dated 25.10.2014 passed by the 3rd respondent indicate various allegations including variation of stock. Now the suspension order is upheld by the appellate authority. In the circumstances, what remains is an enquiry by the 3rd respondent. Since the authorization of the petitioner was suspended on 25.10.2014, this Court is inclined to dispose of the present writ petition directing the 3rd respondent to conduct an enquiry into the allegations levelled against the petitioner and pass final orders thereon, within a period of sixty days from the date of receipt of a copy of this order by duly following the principles of natural justice in the enquiry process.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 14.07.2015 siva
