THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.584 OF 2013 JUDGMENT:

This Second Appeal is filed by the unsuccessful plaintiffs, under Section 100 of C.P.C., assailing the judgment and decree dated 01.02.2013 passed in A.S.No.10 of 2010 on the file of the Court of the Senior Civil Judge, Ramachandrapuram, wherein and whereby the judgment and decree dated 06.11.2009 passed in O.S.No.427 of 2003 on the file of the Court of the Principal Junior Civil Judge, Ramachandrapuram, dismissing the suit filed by the plaintiffs for declaration and consequential perpetual injunction, was confirmed.

At the time of arguments, learned counsel for the appellants submitted that appellant Nos.2 to 4 filed O.S.No.99 of 2010 against the Government challenging the notice dated 04.05.2010 and the same was dismissed. Aggrieved by the same, appellant Nos.2 to 4 have preferred A.S.No.18 of 2015 on the file of the Court of the Senior Civil Judge, Ramachandrapuram, and the same was allowed on 12.03.2018.

In view of the judgment and decree dated 12.03.2018 passed in A.S.No.18 of 2015, no further orders are necessary in this second appeal.

Hence, the Second Appeal is closed. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
