THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.40022 of 2012 ORDER:

This Writ Petition was filed seeking a direction to respondent Nos.1 and 2 to order CBCID enquiry in respect of Crime No.165 of 2012 on the file of Rozole Police Station, Razole, East Godavari District. Learned Government Pleader, on the basis of the written instructions, submits that the petitioner submitted a complaint on 16.11.2012 under Section 384 of IPC against one Md.Rafiuddin. During the course of investigation eight witnesses were examined and their

statements were recorded. The evidence disclosed prima facie case against the accused persons. A charge sheet was filed on 12.03.2014 before the learned Judicial Magistrate of First Class, Razole, and NBWs are pending against the accused. The accused are also involved in another Crime No.221 of 2013 under Sections 384 and 506 IPC and under Section 66-A of the Information Technology Act in Prakashnagar Police Station, Rajahmundry Urban District.

In view of the filing of charge sheet pursuant to the complaint lodged by the petitioner on 16.11.2012, no further adjudication is necessary.

The Writ Petition is, accordingly, closed giving liberty to the petitioner to take appropriate steps in accordance with law in the pending case. The miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed.
