HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.385 OF 2016 ORDER:
The petitioner filed WP.No.42661 of 2015 challenging the inaction of the Thasildar in implementing the orders dated 11.06.2009 passed by the Revenue Divisional Officer, and this Court disposed of the said writ petition on 31.12.2015 directing the Tahasildar to examine the request of the petitioner and take appropriate steps expeditiously. Alleging violation of the said orders, present contempt case is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that when the order of the Revenue Divisional Officer dated 11.06.2009 was challenged in WP.Nos.26009 of 2012 and batch, this Court by common order dated 17.09.2013 allowed the said writ petitions setting aside the order dated 11.06.2009 passed by the Revenue Divisional Officer; and that the said order was communicated to the petitioner vide endorsement dated 03.02.2016, in pursuance to the orders passed in the writ petition No.42661 of 2015.
Now it is to be seen that an endorsement dated 03.02.2016 was issued to the petitioner stating that proceedings dated 11.06.2009 issued by the Revenue Divisional Officer have been set aside by this Court on 17.09.2013 in WP.Nos.26099/2012 and batch. Though learned counsel for the
petitioner states that the petitioner is not a party to the said writ petitions, the fact remains that order 11.06.2009 passed by the Revenue Divisional Officer is set aside. However, under contempt jurisdiction, the validity of the order cannot be decided. If petitioner is aggrieved by the endorsement dated 03.02.2016, it is open for the petitioner to challenge the same in accordance with law.
Accordingly, the Contempt Case is dismissed. No order as to costs.
As a sequel, miscellaneous applications, if any pending in the Contempt Cases shall stand closed.
