The present writ petition is directed against the inaction of the second respondent in registering a case based on the complaint, dated 23.11.2014, lodged by the petitioner.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned counsel for the petitioner submits that the petitioner had made a complaint on 23.11.2014, which has not been taken cognizance of by the authorities by registering a case. Being aggrieved by the said inaction of the authorities, the petitioner claims to have made another complaint to the Commissioner of Police, Cyberabad, on 24.11.2015 and also made a further complaint, dated 30.07.2015. Learned counsel further submits that as there was no action taken by the second respondent based on the complaint made by the petitioner on 23.11.2014, the petitioner sought information under the Right to Information Act, 2005, on 22.11.2017, wherein it is stated that the receipts relating to the petitions could not be traced in the station records, since they are misplaced. 4.

On the other hand, learned Assistant Government Pleader for Home would submit that since the petitioner had made a complaint subsequently on 30.07.2015, the authorities have registered a case thereagainst and are investigating into the matter. It is further stated that, with reference to complaint made on 23.11.2014, since no records are available with the second respondent, the same has not been acted upon.

Having regard to the above submissions, inasmuch as the petitioner made the compliant once again on 30.07.2015, which is duly taken note of by the authorities, and a case having been registered, no further orders need be passed in the writ petition directing the second respondent to register the complaint of the petitioner dated 23.11.2014 at this late stage, after a lapse of more than five years particularly considering the fact that the offence which is sought to be complained of is not a continuing offence.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
