HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10292 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in terminating the petitioner from service vide orders dated 30.04.2003, as illegal and arbitrary. A consequential direction is also sought to the respondent bank to continue the petitioner with all allowances and benefits. Heard and perused the material available on record. It has been contended by the petitioner that he was appointed as Attender in the 5th respondent bank on compassionate grounds in the year 2000 and, subsequently, his services were terminated by the 5th respondent bank vide orders dated 30.04.2003 on the ground that his appointment is contrary to Act 2/1994. Aggrieved by the same, the present writ petition is filed.

It is brought to the notice of the Court that while admitting the writ petition, this Court granted interim suspension of the order of termination of the services of the petitioner, vide order dated 27.05.2003 in WPMP No.12945 of 2003, and by virtue of the interim orders, the petitioner is continuing in service. Having considered the submissions made by the parties and perused the material on record, this Court is of the view that ends of justice would be met, if the respondents are directed not to disturb the

petitioner and consider his case for regular appointment, if the petitioner is continuing in service.

With the above observation, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 6th September, 2018 cbs
