WRIT PETITION No. 21501 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No. 18 of Singarayapalem Thanda, Machavaram Mandal, Guntur District. The stock to the petitioner was supplied till June, 2015 and when it was not supplied for the month of July, 2015, the present Writ Petition is filed.

The learned Government Pleader on instructions submits that a show cause notice was issued by the second respondent on 20.6.2015 and the petitioner submitted his explanation on 23.6.2015 in respect of the charges levelled against him and that 6A proceedings are pending. In view of the above averments, it is to be seen that so long as the authorization of the petitioner is in force, the petitioner is entitled for supply of stock for onward distribution to the cardholders. In the circumstances, respondents 2 and 3 are directed to supply stock to the petitioner so long as his authorization is valid and in force.

The Writ Petition is accordingly allowed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
