THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.539 of 2016 ORDER:
The petitioners preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 01.02.2016 passed in Crl.M.P.No.26 of 2016 in Criminal Appeal No.11 of 2016 by the Additional Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, R.R. District, whereby the learned Judge allowed the application, filed by the petitioners by directing the 1st petitioner to deposit half of the arrears of the amount ordered by the trial Court and also to pay future maintenance @ Rs.10,000/- per month to the 2nd respondent on or before 10th of every succeeding month.
Heard and perused the material available on record. Learned counsel for the petitioner submitted that the petitioner is not in a position to pay Rs.10,000/- per month as interim maintenance to the 2nd respondent as directed by the appellate Court and he could prove before the appellate Court that he could not pay the amount as ordered by the appellate Court and prayed this Court to direct the appellate Court to dispose of the appeal as early as possible. In view of the above submission, the learned Additional Metropolitan Sessions Judge, Cyberabad is directed to dispose of Crl.A. No.11 of 2016 as expeditiously as possible by giving preference, preferably on or before 25.03.2016.
With the above directions, the Criminal Revision Case is disposed of. Miscellaneous petitions, pending if any, shall stand closed.
