THE HON'BLE JUSTICE SMT. KONGARA VIJAYA LAKSHMI WRIT PETITION No.14297 of 2013 ORDER :

This writ petition is filed to declare the action of the respondents in interfering with the construction of the petitioner over Plot No.51 (Part) over an extent of 150 square yards in Sy.No.337 to 342 situated at Chandanagar Village, Serilingampally Mandal, Ranga Reddy District, as arbitrary and illegal. The case of the petitioner is that he purchased Plot No.51 (part) to an extent of 150 square yards in Sy.No.337 to 342 in Chandanagar Village, Serilingampally Mandal, Ranga Reddy District by a registered sale deed; when the respondents have granted construction permission on 28-09-2015 and when the construction is under progress, the staff of the respondent No.2 came to the subject property and threatened demolition of the construction on the ground that the construction is illegal. Hence, the writ petition.

Today when the matter came up for hearing, Sri Sampath Prabhakar Reddy, learned Standing Counsel submits that the construction of the subject building is over; there are certain deviations with regard to the subject building and that they would issue appropriate notice in accordance with law. As the prayer in the writ petition itself is to declare the action of the respondents in interfering with the construction of the petitioners as illegal and as the Standing Counsel represents that the construction of the building is already over; if there are any deviations made by the petitioner with regard to the subject

building, the respondents are at liberty to follow the procedure as contemplated under law by issuing appropriate notice to the petitioner.
