THE HON'BLE SRI JUSTICE K.C.BHANU CONTEMPT CASE NO. 2205 of 2014 ORDER:

This contempt case is filed alleging willful disobedience of the order dated 29.08.2012 in Writ Petition No.25632 of 2012 passed by this Court.

2. Heard both sides.

3. The Writ Petition was filed challenging the action of the respondents 1 to 3 in the Writ Petition in contemplating to shift Dhone Rural Police Station from Kotalavaripalli Junction, Dhone Mandal, Kurnool District to N.H.7, near Kotla Vijaya Bhaskar Reddy Market Yard, Dhone Urban, Kurnool District. The learned Standing Counsel appearing for the fourth respondent in the Writ Petition submitted in the Writ Petition that in pursuance of the permission given by the Tahsildar, Dhone Mandal, the fourth respondent called for tenders for construction of the police station building at Dharmavaram village by the side of the present building of Dhone Rural Police Station at Kotlavaripalli village and that an agreement was also entered into between the contractor and the fourth respondent for the said work.

This Court closed the Writ Petition vide its order dated 29.08.2012 recording the submission made by the learned Standing Counsel for the fourth respondent, and observing that as the construction of the permanent building of Dhone Rural Police Station has already been commenced and is in progress, the question of shifting of the police station from Kotlavaripalli village to another village does not arise. Grievance of the petitioner is that there is a proposal for shifting of the police station now. That may give rise to a fresh cause of action for the petitioner to file a petition challenging the acts of the respondents. The findings recoded on the instructions of the learned Standing Counsel for the fourth respondent in the Writ Petition are not shown to be false or incorrect. There is no willful disobedience of the order of this Court.

4. The Contempt Case is, therefore, closed, leaving open the remedies available to the petitioner. No costs. Miscellaneous Petitions, if any, pending in this Contempt Case shall stand closed.
