THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8014 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.12 in Crime No.86 of 2022 pending on the file of Station House Officer, Srirampur Police Station, Mancherial registered for the offences punishable under Sections 109, 202 and 302 read with Section 149 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused No.12 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner who is Accused No.12 is that he was part of the Accused Nos.1 to 15 who attacked and killed the deceased. It is the case of the prosecution that Accused No.1 collected the gang members who are Accused Nos.2 to 12 formed into an unlawful assembly and attacked the deceased.

Learned counsel for the petitioner/Accused No.12 submits that in the remand report no specific overtacts are attributed to this petitioner except stating that he was part of the 15 members of gang who attacked the deceased.

In the said circumstances, the petitioner who is in jail since 11.08.2022 can be granted the relief of regular bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.12 is granted bail subject to the following conditions:

i) The petitioner/Accused No.12 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of I Additional District and Sessions Judge at Mancherial.

ii) The petitioner/Accused No.12 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of three (03) months or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused No.12 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 13.09.2022 ns
