THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9008 of 2015 ORDER:
The grievance of the petitioners is non-disposal of O.S.No.34 of 2009 pending before the 2nd respondent-Agent to the Government. The petitioners submit that they are defendants in the said suit filed by the 5th respondent herein. The plaintiff/5th respondent is depositing the lease amount to the credit of the suit from the year 2009 onwards. Inspite of the fact that the petitioners filed interlocutory applications seeking disbursal of the deposited amounts, no orders have been passed, thereby depriving the petitioners the fruits of the land.
2. Considering the limited prayer in the writ petition, the writ petition is disposed of directing the 2nd respondent to dispose of the suit O.S.No.34 of 2009, in accordance with law, within a period of six months from today. Further, as an interim measure, the 2nd respondent may consider passing of orders in the interlocutory applications viz., I.A. No.23 of 2009 and I.A. No.18 of 2011 filed by the petitioners wherein they sought disbursal of the amount which has been deposited by the 5th respondent to the credit of the suit. No order as to costs.
