THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27367 of 2019 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that the Hon'ble Court may be pleased to issue a writ, order or direction, more particularly a writ in the nature of Writ of MANDAMUS declaring the inaction of the 1st respondent i.e., Commissioner of Endowments, State of Telangana, Boggulakunta, Tilak Road, Abids, Hyderabad in not releasing the grant sanctioned for the construction of Raja Gopuram to Sri Ranganayaka Swamy Temple at Mogiligidda Village, Farooqnagar Mandal, Mahaboobnagar District as bad, illegal, arbitrary, opposed to law and pass such other order or orders as this Hon'ble Court may deem fit and proper."

Heard Sri M.Vidyasagar, learned counsel appearing for the petitioner, learned Government Pleader for Endowments appearing for respondent Nos.1, 2 & 4 and Sri Kotha Jagan Mohan Reddy, learned counsel appearing for the 3rd respondent. Perused the material available on record.

It is the case of the petitioner that despite depositing the requisite amount of 20% before the official respondents for construction of Raja Gopuram of Sri Ranganayaka Swamy Temple, situated at Mogiligidda Village, Farooqnagar Mandal, Mahaboobnagar District, no action has been initiated by the 1st respondent-Commissioner of Endowments in this regard.

Learned Government Pleader for Endowments, upon instructions, submits that when once the petitioner places the proof of payment of 20% of the amount before the 1st respondent-Commissioner of Endowments, then within a period of four (04) weeks, the 1st respondent would decide the matter, in accordance with law.

In view of the same, the Writ Petition is disposed of directing the petitioner to place the proof of payment of 20% of the amount before the 1st respondent-Commissioner of Endowments under proper acknowledgment and on such receipt, the 1st respondent-Commissioner of Endowments shall take necessary action for releasing of the remaining funds for construction of the Raja Gopuram of Sri Ranganayaka Swamy Temple, situated at Mogiligidda Village, Farooqnagar Mandal, Mahaboobnagar District, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
