This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner who is arrayed as Accused No.135 seeking bail in the event of his arrest in connection with Crime No.374 of 2022 on the file of Station House Officer, Osmania University Police Station, Hyderabad, registered for the offence punishable under Section 8(c) read with 22(b) and 27 of NDPS Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.

The Police of Osmania University arrested Accused No.1 who is a drug peddler and thereafter during the course of investigation, implicated all the members who are found in the contact list of Accused No.1. The allegation against this petitioner is that he was a consumer who purchased drugs from Accused No.1. 4.

In the said circumstances, as there is no allegation that this petitioner had indulged in any sale of drugs and the allegation is that he has consumed drugs purchasing the same from Accused No.1, this petitioner can be granted can be granted the relief of

Crl.Petition No.7972 of 2022 Anticipatory Bail in the event of his arrest, subject to the following conditions:

i) The petitioner/Accused No.135 is directed to surrender before the Station House Officer, Osmania University Police Station, Hyderabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A135 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to its satisfaction.

ii) On such release, the petitioner/Accused No.135 shall appear before the concerned Station House Officer on every Saturday between 10.00 A.M to 1.00 P.M for a period of eight weeks, for the purpose of investigation.

iii) The petitioner/Accused No.135 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.
