THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8747 of 2015 ORDER:

It is the case of the petitioners that the respondent authorities have handed over house sites to them in the year 1984 as per the policy decision of the Government at that time and they are residing in the house sites, but, however, they were not issued with house site pattas at the time of handing over of house sites. They state that they are regularly paying relevant taxes to the Gram Panchayat and electricity connections were also provided to them. While so, the 4th respondent issued Notice dated 13.03.2015 under Section 7 of the A.P. Land Encroachment Act, 1905, to which they submitted their explanation on 23.03.2015, but still the 4th respondent is taking steps to evict them from the house sites in their occupation.

2. Learned counsel for the petitioners submits that though the petitioners filed their objections on 23.03.2015 to the impugned notice, but to the best of their knowledge, no orders were passed, and the 4th respondent is trying to evict the petitioners.

3. In that view of the matter, the writ petition is disposed of with a direction to the 4th respondent consider the objections filed by the petitioners and pass orders, in accordance with law, after giving opportunity of hearing to the petitioners. However, if any adverse order is passed, the petitioners are at liberty to challenge the same, in accordance with law. No order as to costs.
