THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9228 of 2015 ORDER:
The petitioner was appointed as Fair Price Shop dealer on permanent basis in respect of Shop No.8, Butchaiah Gari Palli Village, Bukkapatnam Mandal, Anantapuram District.
The authorisation of the petitioner is valid upto 31.03.2016. When the respondents did not supply the essential commodities, the petitioner filed W.P.No.8255/2015. When the learned Government Pleader took time to get instructions, on 24.03.2015 it came to light that the impugned order of suspension-cum-show cause notice was issued on 23.03.2015 framing two charges against the petitioner. Challenging the same, the present writ petition is filed. Learned counsel for the petitioner submits that a perusal of the impugned order of suspension-cum-show cause notice clearly shows that there was no proper application of mind as could be seen in respect of the quantities mentioned in the charge No.1. He further submits that the charge No.2 is a vague charge without any particulars. However, this Court is not inclined to interfere with the enquiry process at this stage as the petitioner has not yet submitted his explanation.
In the above circumstances, the petitioner is given liberty to submit his explanation within fifteen (15) days from the date of receipt of a copy of this order, and the second respondent shall complete the enquiry in respect of the allegations against the petitioner within thirty
(30) days thereafter by giving due opportunity to the petitioner. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
