HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No.8542 of 2016 Order:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.27 of 2015 of P.S.C.I.D T.S., Hyderabad, registered for the offences punishable under Sections 120-B, 386, 420 and 506 read with Section 34 IPC, Section 25(2) of Arms Act and Sections 3 and 5(a)(b) of Andhra Pradesh Money Lenders Act (Telangana Area).
2. Heard the learned counsel appearing for the petitioner-accused No.3 and the learned Additional Public Prosecutor representing the State.
3. Specific allegations were made against the petitioner in the complaint. This is a matter which requires investigation by the police. The truth or otherwise of the allegations can only be decided during the course of investigation or trial.
I see no ground to interdict the investigation at this stage and quash the first information report.
4. In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner-accused No.3 in the above crime, for a period of one month from today. The petitioner-accused No.3 shall appear before the investigating agency as and when required during the course of investigation. The miscellaneous applications, if any, pending in this criminal petition shall stand closed in consequence.
