HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.31981 of 2015 ORDER:

This writ petition is filed seeking to declare the proceedings dated 20.09.2013 issued by the 2nd respondent as illegal and arbitrary.

The petitioner joined in the respondent-Corporation initially as Work Inspector and subsequently, he was promoted as Assistant Executive Engineer. On the allegation that he was in possession of disproportionate assets to the known source of income, the ACB authorities arrested him on 12.6.2013 and later he was enlarged on bail on 24.09.2013. Pursuant to the same, the 2nd respondent vide impugned proceedings dated 20.09.2013 placed him under suspension.

Learned counsel appearing for the petitioner submits that the petitioner is kept under suspension since more than two years. He further submits that though he submitted representations on 16.03.2015 & 18.09.2015, no action has been taken thereon so far.

Learned Standing Counsel appearing for the respondentCorporation would submit that the representation submitted by the petitioner was received on 19.09.2015. In any event, the fact remains that the representation submitted by the petitioner was received by the respondentCorporation. Therefore, the first respondent is directed to examine the representation and review the suspension order in the light of G.O.Ms.No.526 GA (Ser.C) Department, dated 19.08.2008 and pass appropriate orders within a period of four

weeks from the date of receipt of a copy of this order. Writ Petition is disposed of accordingly. No costs. Miscellaneous petitions pending, if any, shall stand closed.
