THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8177 of 2012 ORDER:

The Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner/A.3 seeking to quash the proceedings in F.I.R.No.202 of 2012 registered for the offences under Sections 323, 506, 465, 467, 468, 471 read with Section 34 IPC on the file of the P.S., Bhogapuram, Vizianagaram District.

Heard and perused the material available on record. When the case is taken up for hearing, learned counsel for the petitioner submits that the parties, more particularly A.1 in the above crime entered into compromise with the de facto complainant and thereby, they settled the issue. One of the clauses in the Award, dated 05.11.2013, passed by the Lok Adalat Bench, at Vizianagaram, runs as follows. "5. That the defendant should withdraw the criminal case filed by her before the Additional Judicial First Class Magistrate, Vizianagaram, against the plaintiff which was forwarded and registered as Cr.No.202 of 2012 by the S.H.O., Bhogapuram Police Station."

In view of the Award passed by the Lok Adalat, the criminal petition is allowed and the proceedings in F.I.R.No.202 of 2012 on the file of the P.S., Bhogapuram, Vizianagaram District, is hereby quashed and the petitioner is acquitted of the offences alleged against him. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
