ORDER
Heard learned counsel for the petitioner and learned Government Pleader for Home.
2. It is the case of the petitioner that his vehicle bearing No.AP-26-Y-4669 was seized on 25-04-2015 in respect of Cr.No.53 of 2015 of Kamalapuram Police Station, Kadapa District, for the offences punishable under Section 420 read with 34 IPC and Section 7(1) of the E.C.Act. Aggrieved by the said seizure, the present writ petition is filed.
3. Learned Assistant Government Pleader has produced instructions admitting the seizure of the said vehicle on the ground of illegal transportation of PDS rice in the said vehicle and the Tahsildar has taken the said PDS rice and requested the police to keep the said vehicle in the police station for safe custody.
4. When once the vehicle is seized, the concerned police has to produce the same either before the concerned Court or Authority in accordance with law.
5. In view of the same, the Station House Officer-2nd respondent is directed to produce the vehicle before the concerned Court or Authority and the petitioner is directed to make an application for release of the vehicle before the concerned Court or Authority. As and when such application is filed, the
concerned Court or Authority shall pass appropriate orders in accordance with law.
6. With the above direction, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
