THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7977 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.4 and 5 in the event of their arrest in Crime No.35 of 2022 on the file of Station House Officer, Yergatla Police Station, Nizamabad District registered for the offence punishable under Section 304-B of Indian Penal Code.

Heard learned counsel for petitioners/Accused Nos.4 and 5 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The facts of the case are that the petitioners are sisters of Accused No.1. Accused No.1 was married to the deceased on 10.06.2019 and thereafter it is alleged that the parents-in-law and these petitioners who are sisters-in-law have allegedly demanded additional dowry from the wife of Accused No.1. Unable to bear the harassment it is alleged that the wife of Accused No.1 committed suicide on 25.07.2022.

As seen from the remand report of Accused Nos.1 to 3, these petitioners who are sisters of Accused No.1 are already married and residing separately. The only allegation made in the complaint that these petitioners have abetted Accused No.1 in demanding additional dowry. In the said circumstances, these petitioners can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.4 and 5 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.4 and 5 are directed to surrender before the Station House Officer, Yergatla Police Station, Nizamabad District within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.4 and 5 shall appear before the investigating authorities as and when required for the purpose of investigation.
iii) The petitioners/Accused Nos.4 and 5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
