THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15773 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not impounding the Agreement of sale cum General Power of Attorney, dated 14.03.2001 and the consequential action of the 2nd respondent in not receiving the document for registration, as illegal and arbitrary and for a consequential direction to the 2nd respondent to receive the AGPA dated 14.03.2001 and regular sale deed in favour of the 2nd petitioner and process the same for impounding and registering the sale deed.

Learned Assistant Government Pleader for Stamps and Registration submits that the document is of the year 14.03.2001, as such, the petitioner has to approach the District Registrar for impounding the same.

Learned Counsel for the petitioner submits that the petitioner will approach the District Registrar. In view of the above, it is open for the petitioner to approach the District Registrar for impounding the document and on presentation of the document by the petitioner for impounding, the District Registrar has to pass appropriate orders and take appropriate action, in accordance with law. As far as presentation of sale deed is concerned, the 2nd respondent is directed to receive and register the same, if the same is in

order as per the provisions of Indian Stamps and Registration Act and the Rules made thereunder, and if the subject land is not included in the list of prohibited properties for registration as per Section 22-A of the Registration Act, 1908 or not prohibited for registration by any order/injunction/attachment passed by the Court or competent authority. If he wants to refuse registration, he shall record reasons as per Section 71 of the Registration Act, 1908 and communicate the same to the parties.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 28.04.2017 t k.
