O R D E R

The case of the petitioner is that, he is the owner of the subject property in an extent of Ac.1.04 guntas in Sy.No.19/2/2/AA in Sub Division No.19/2 of Peddireddygudem village of Annapureddypalli Mandal in Bhadradrikothagudem District, and he raised mango and teak trees in the subject property. As there are standing trees in the subject property which was acquired, and the 5th respondent - District Collector, is the competent authority in the scheduled areas to grant permission for cutting of trees, petitioner, through proper channel, represented the matter, and in pursuance thereof, the 4th respondent - Forest Range Officer, vide proposals in Rc.No.547/2019/S2 dated 09.08.2019, requested the 5th respondent to grant necessary felling permission. In spite of the proposals of the 4th respondent, as the 5th respondent did not grant any permission, the present writ petition came to be filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleaders for Forests, Revenue and Irrigation and Command Area Development for respective respondents.

Having regard to the facts and circumstances of the case and the submissions of the learned counsel, writ petition is disposed of directing the 5th respondent - District Collector, Bhadradri Kothalgudem District at Kothagudem, to pass appropriate orders in accordance with law for grant of permission for cutting the trees in the subject property in the light of the recommendations of the 4th respondent dated 09.08.2019, within a period of four weeks from the date of receipt of a copy of this order. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
