ORDER:- Heard.

2. Petitioner seeks correction of his date of birth as well as correction of his name in the passport issued to him and places reliance upon his Secondary School Certificate, which mentions the name and the date of birth

correctly. Alleging that the second respondent is not accepting the application of the petitioner for renewal and correction, present writ petition is filed.

3. Obviously, the passport was issued to the petitioner on 24.01.2006 and in terms of the circular of the Ministry of External Affairs, correction can be made by the passport officer within a period of two years of issuance of passport and for any period beyond two years, petitioner has to approach appropriate civil court. In view of the remedy available to the petitioner to approach the competent civil court, the relief sought for in this writ petition cannot be considered.

4. Writ petition is disposed of granting liberty to the petitioner to move the competent civil court for necessary relief and if such a suit is filed, the competent court shall entertain the same and dispose of the same expeditiously in accordance with law.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
