HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10495 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondents to furnish a copy of enquiry report and final order in regard to the charge sheet dated 26.07.1986 and to pay the arrears of increments from 1987 to 1991 with all consequential benefits.

When the matter is taken up for hearing, it is noticed that the petitioner is not challenging the order of punishment dated 18.03.1987, but he is seeking a direction to the respondents to furnish a copy of enquiry report and final order in regard to the charge sheet dated 26.07.1986. The relief prayed by the petitioner cannot be granted, as the order of punishment is staring at the petitioner. Further, it is reported by the learned counsel for the petitioner that the petitioner had retired from service during pendency of the writ petition.

In view of the above, the cause in the writ petition does not survive for adjudication. Therefore, the writ petition is dismissed as infructuous. However, the petitioner is at liberty to challenge the order of punishment dated 18.03.1987, if he is so advised.
