HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.26939 of 2008 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Land Acquisition.

The present writ petition came to be filed seeking issuance of writ of mandamus directing respondent Nos.1 and 2 to consider and dispose of the objections dated 04.12.2008 filed by the petitioner in pursuance of Section 4 (1) Notification dated 08.11.2008 issued by respondent No.1 to acquire the land of the petitioner admeasuring Ac.5.00 in Sy.No.394/1, 2 situated in Chinnayagudem Village, Devarapalli Mandal, West Godavari District for house sites; and consequently to direct the respondents not to dispossess the petitioner from the said land.

At the time when the matter is taken up for hearing, the Government Pleader for Land Acquisition submitted that no further orders are necessary in the writ petition since there was no progress after issuance of notice, dated 15.11.2008, under Section 5 A of the Land Acquisition Act. It is further stated that the proceedings have also lapsed.

In view of the above, this Court is of the opinion that nothing survives for adjudication in the writ petition and accordingly, the writ petition is closed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
