Achyuta Srinivasa Rao, Guntur Dist v. Kantam Venkateswara Reddy [Died] And 2 Others
THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY C.R.P.No.2725 of 2012
ORDER
This revision under Section 115 of C.P.P., is filed challenging the order dated 26.04.2012 passed in E.P.No.66 of 2008 in O.S.No.58 of 1999 by the Principal Junior Civil Judge, Mangalgiri. 2.
The petitioner herein is judgment debtor in E.P.No.66 of 2008. At the time of filing this revision, an interim order was obtained by the petitioner, but the same was not complied. Thereafter, the executing Court proceeded with the execution of the decree, and on production of petitioner/J.Dr., before the Court and after his arrest, he deposited the entire decretal amount.
3.
Learned counsel for respondents/D.Hrs., represented that the respondents filed a cheque petition and the same is pending as it was not entertained because of pendency of the civil revision petition. He submits that the present revision has become infructuous in view of the fact that the entire decretal amount has been paid by the petitioner and closure of execution petition. 4.
Hence, the Civil Revision Petition is dismissed as infructuous and the stay granted by this Court on 10.07.2012 is deemed to have been vacated. No order as to costs. Miscellaneous petitions, if any, pending in this revision shall stand dismissed. _______________________________ M. SATYANARAYANA MURTHY, J 15th March, 2018 sj
